## About these Terms

These Terms of Service are an agreement between you and Instamora ("we", "us"). They apply whenever you use instamora.com, including its chats, character profiles and other features (together, the "service").

These policies are part of the Terms:

- [Privacy Policy](https://instamora.com/privacy)
- [Cookie Policy](https://instamora.com/cookies)
- [Billing, Subscriptions and Refunds](https://instamora.com/refunds)
- [Acceptable Use Policy](https://instamora.com/acceptable-use)
- [Complaints and Content Removal](https://instamora.com/content-removal)
- [Age Policy and Underage Reports](https://instamora.com/underage)
- [AI Transparency](https://instamora.com/ai-transparency)

By using the service you accept these Terms. If you do not accept them, do not use Instamora.

## Who can use Instamora

Instamora is for adults only. You must be at least 18 years old, or the age of majority where you live if that is higher, and adult content must be legal for you where you are.

We ask you to confirm your age before you start chatting and, if you have not confirmed it yet, before checkout. If we have reason to believe a user is under 18, we lock the chat and may close the account, as described in the [Age Policy](https://instamora.com/underage).

Some countries and US states require a stronger age check before adult content, for example the United Kingdom, France, Germany and Italy. In those places conversations stay non-explicit until we can offer an approved age check. We may also limit other features by location when the law requires it.

If we closed an account of yours for breaking these Terms, you may not open a new one unless we agree in writing.

## What Instamora is

Instamora is an entertainment service for romantic and flirty conversations with characters. Every Instamora character is an AI character. The characters, their portraits and photos, and the conversations are made with artificial intelligence. Replies are generated by AI models, and some are prewritten lines that our system picks automatically. No person writes or sends them.

All characters are fictional adults. A character does not represent a real person, and any resemblance to a real person is unintended. If you believe a character looks like you or someone you represent, see [Complaints and Content Removal](https://instamora.com/content-removal).

A character exists only inside Instamora. She cannot meet you, call you, send you anything outside the service or keep a promise in the real world. What she says about her life, feelings and plans is part of the story.

Characters can make mistakes and can say things that are untrue. Instamora does not give medical, psychological, legal or financial advice, and it is not a crisis service. If you are in danger or thinking about harming yourself, contact your local emergency number. In the US you can call or text 988, and in other countries you can find a helpline at [findahelpline.com](https://findahelpline.com).

[AI Transparency](https://instamora.com/ai-transparency) explains how characters and replies are made.

## Fantasy roleplay

In some parts of Instamora you set up your match before you chat: her relationship to you, her occupation, her personality and up to three things she is into. By choosing them you ask for that roleplay and agree to it. The roleplay is fiction between adults, and these rules apply to it:

- Step and in-law roles are relations by marriage. No character is related to you by blood.
- Scenes of force, blackmail or humiliation happen because you chose them, and they stay in the story.
- Financial domination stays in words. A character never asks you for money, gifts or payment details, and your conversation never depends on buying anything.
- Dependency, jealousy and mind games stay inside the story. A character does not try to turn you away from the people in your life or from getting help.

Say stop at any time and the scene ends. You can change your choices whenever you like. The [Acceptable Use Policy](https://instamora.com/acceptable-use) lists what is never allowed, even as fiction.

## Your account

You can use Instamora as a guest. A guest's conversations are tied to a cookie in that browser, so clearing cookies or changing browsers ends access to them.

To create an account, sign in with Google, with Apple or with a one-time link sent to your email address. We never ask for a password. One account covers all of Instamora: your conversations, Credits and purchases stay with it on every device where you sign in.

- Keep your email account and your sign-in links private. You are responsible for what happens in your Instamora account.
- Use one account per person. Do not share, sell or transfer it.
- Make sure the email address on your account can receive mail. We use it for sign-in links and, once checkout opens, for receipts and notices about your plan.

You can stop using Instamora at any time. The [Privacy Policy](https://instamora.com/privacy) explains how to have your account and its data deleted.

## Free messages, Credits and paid plans

- As a guest you can send 10 messages for free, shared across all characters. If many guests use the same network, we may ask you to sign in sooner.
- A new account receives 10 promotional Credits once.
- After that, replies and some features cost Credits. Each feature shows its price in Credits before you confirm.
- Credits are a license to use features inside Instamora. They have no cash value. You cannot sell or transfer them, and we exchange them for money only as described in [Billing, Subscriptions and Refunds](https://instamora.com/refunds).
- Promotional Credits are spent before purchased Credits.
- Credits do not expire. This covers purchased Credits and promotional Credits, the welcome Credits included. If we ever decide that promotional Credits should expire, we will announce it at least 30 days before the change takes effect.
- Gifts are voluntary. A gift does not include a promised reply or extra content.

Instamora Premium, character memberships and Credit packs are priced in US dollars. Before you buy, the review screen shows the item, the price and, for a plan, how it renews. [Billing, Subscriptions and Refunds](https://instamora.com/refunds) covers renewals, cancellation, refunds and chargebacks.

Checkout is not open yet. If you choose a plan or a Credit pack now, we save your choice and the terms you saw. We do not ask for card details and we do not charge you.

## Rules for using Instamora

Use Instamora for your own personal, non-commercial use and follow the [Acceptable Use Policy](https://instamora.com/acceptable-use). Among other things, you may not:

- involve anyone under 18 in any way, or ask a character to act or look younger than an adult;
- use Instamora to sexualize real people, or to create or share intimate images of anyone without their consent;
- break the law, harass anyone or share another person's private information;
- use bots, scrapers or other automated access, except search engines and other crawlers that follow our robots.txt on the public pages;
- try to get around our limits or safety checks;
- copy, resell or publish character images, profiles or conversations.

## Safety

Our system checks each message you send, and each reply before you see it. If a message shows that the user is under 18, the character tells them that they are too young to be here. After that, every character gives the same answer to every message in that browser and on that account. If a message mentions self-harm, the character answers with support and crisis resources, and that first reply is free.

You can report a safety problem at any time to [abuse@instamora.com](mailto:abuse@instamora.com). [Complaints and Content Removal](https://instamora.com/content-removal) explains how we handle reports.

## Content and intellectual property

Instamora and its licensors own the service, the characters (their names, profiles, images and stories) and the design of the site. While you follow these Terms, we give you a personal, limited, non-transferable and revocable license to use the service and to view its content for your own non-commercial use.

You keep the rights you have in the messages you write. You give us a license to store, process and display them, and to send them to the providers that generate replies, for as long as we need to provide the service to you, keep it safe and meet our legal duties. We do not publish your conversations.

The replies a character writes to you are for your personal use. Do not present them as written by a real person, and do not use them to depict a real person.

If you send us feedback or ideas, we may use them without owing you anything.

## Moderation and enforcement

We use automatic checks on messages and replies, and we review the reports people send us. If you break these Terms or the Acceptable Use Policy, or if the law requires us to act, we may:

- block a message or end a scene;
- limit features, or lock a chat as described under "Safety";
- suspend or close your account;
- report illegal content to the authorities, including reports to the National Center for Missing & Exploited Children (NCMEC) where the law requires them.

We tell you what we did and why, unless the law, a safety risk or an ongoing investigation prevents it. You can appeal a decision as described in [Complaints and Content Removal](https://instamora.com/content-removal). [Billing, Subscriptions and Refunds](https://instamora.com/refunds) explains what happens to plans and Credits when an account is closed.

## Changes to the service

Instamora is new and changes often. We may add, change or remove characters and features. A feature marked "Soon" or "not available yet" cannot be bought until it is ready.

If we remove a character, the items you unlocked from her stay in your library where we can keep them. If we cannot keep them, we return the Credits you spent on them. If a change removes something that a paid plan includes, we tell you before it applies, and you can cancel.

We work to keep Instamora available, but we do not promise that it will always be online or free of errors.

## Disclaimers and liability

We provide Instamora as it is and as available. To the extent the law allows, we make no promises about the service beyond those in these Terms, for example that it will meet your expectations or that replies will be accurate.

To the extent the law allows:

- we are not liable for indirect or consequential losses, such as lost profits or lost data, or for losses that we could not reasonably foresee;
- our total liability to you for all claims about the service is limited to the greater of 100 US dollars and the amount you paid us in the 12 months before the claim arose.

Nothing in these Terms limits liability that the law does not allow us to limit, such as liability for fraud or for death or personal injury caused by negligence. Nothing in these Terms takes away your rights as a consumer under the law of the country where you live.

If you break these Terms or the law and someone makes a claim against us because of it, you are responsible for the resulting costs, to the extent the law allows.

## Ending these Terms

You can stop using Instamora at any time and ask us to delete your account. We may suspend or close an account as described under "Moderation and enforcement". We may also close the service after giving reasonable notice. If we close the service, or close your account when you have not broken these Terms, we refund the unused part of any paid plan and any unused purchased Credits.

The parts of these Terms that by their nature should continue, such as "Content and intellectual property", "Disclaimers and liability" and "Disputes and governing law", continue to apply after your use ends.

## Disputes and governing law

If you have a problem with Instamora, write to [support@instamora.com](mailto:support@instamora.com) first. We decide on complaints within 7 business days.

You keep the protection of the consumer law of the country where you live, and you can bring a claim in its courts where that law allows it.

## Changes to these Terms

We may update these Terms. The date and version at the top of this page change with each update. If a change affects you, for example a change to prices, renewals or your rights, we tell you by email or in the service before it applies. If you keep using Instamora after a change takes effect, the new Terms apply to you. If you do not agree with a change, stop using the service and cancel any plan before the change applies.

## Other terms

- These Terms and the policies listed above are the whole agreement between you and us about the service.
- If a court finds part of these Terms invalid, the rest stays in force.
- If we wait before enforcing a right, we can still enforce it later.
- We may transfer these Terms to a business that takes over Instamora, and your rights under them stay the same. You may not transfer your rights under these Terms.
- We communicate with you in English, by email or in the service.
